1. Parties and scope
The website sonadoraproduction.com and the Sonadora trade mark belong to two affiliated companies:
- TMS BRAND COMPANY LTD, a company registered in England and Wales, Company No. 16958162, address: The Business Resource Network, 53 Whateley's Drive, Kenilworth, Warwickshire, CV8 2GY, England — the seller for most markets;
- TMS BRAND COMPANY INC., a corporation incorporated in Delaware, United States, EIN 99-5026347, address: 3524 Silverside Rd, Ste 35B, Wilmington, DE 19810, USA — the seller for the following markets: United States, Puerto Rico, Bolivia, Costa Rica, Dominican Republic, Ecuador, Guatemala, Nicaragua, Panama, Paraguay, El Salvador, Pakistan, Indonesia, Philippines, Vietnam, Thailand, Malaysia, Türkiye, Bahrain, Egypt, Morocco, Nigeria, Kenya, South Africa, Tanzania, Uganda, Rwanda, Côte d’Ivoire, Cameroon.
The contract is concluded between you and the selling company for your market (“we”, “us”). For United States, this is TMS BRAND COMPANY INC.. The seller’s name is also shown on the payment page and on the electronic receipt; in the event of any discrepancy, the details on the receipt prevail.
Our products are intended for consumers aged 18 or over. A person under 18 may place an order only with the consent of a parent or guardian.
2. Products
We create personalised digital products to order: custom songs and animated films, as well as other formats published in our catalogue. The content, length, file format, timings and price of each product are stated on its page. Products are delivered in electronic form only; we do not sell physical goods.
Each product is unique and created for a specific customer. We use AI tools at the stages of creating music, vocals, images and animation, as described in our AI and content policy.
3. Ordering process
- Order request. You submit an order request on the website or in a chat. The request is free of charge and is neither a payment nor an obligation to buy the product.
- Preview. We create the product and send you a preview (a watermarked excerpt) together with a payment link. We may decline a request that breaches section 10 without giving reasons.
- Formation of the contract. The contract for the purchase of the product is deemed concluded at the moment of successful payment via the link.
- Delivery. After payment, we send the full version of the product to your email and to the messenger specified in your order request.
4. Prices and payment
Prices are shown on the website in your market’s currency. Sales tax, where it applies in your state, is calculated at checkout. The price stated in the payment link is final and does not change after the preview.
Payments are accepted by certified payment providers. Methods available for United States: Visa / Mastercard / Amex, Apple Pay, Google Pay, Klarna, Afterpay, Cash App Pay, Amazon Pay, ACH. We do not receive or store your full card details. There are no subscriptions or automatic recurring charges. The payment appears on your bank statement as SONADORA STUDIO.
Depending on your market and payment method, payments are processed by Stripe, EBANX, Cashfree Payments or dLocal on behalf of the seller. The payment page shows the seller’s name, and your bank statement may also show the name of the payment processor next to SONADORA STUDIO.
Your bank or payment system may charge its own fees for currency conversion or international transactions. These fees are beyond our control.
5. Production and delivery
Estimated preview times are stated on the product pages. We deliver the full version within 24 hours of payment, unless otherwise stated on the product page. The delivery procedure is described on the Delivery page. If we fail to deliver a paid product within 72 hours of payment, you may cancel the order and receive a full refund.
6. Revisions
Each order includes up to two free revisions within the scope of the original order request: changes to the lyrics, details, style or individual scenes. Revisions may be requested before payment and within 14 days of delivery. A change of hero, occasion or core idea is treated as a new order.
7. Right of withdrawal and refunds
The grounds and procedure for refunds are set out in the Refunds and revisions policy, which forms part of these terms.
The product is digital content made to your individual specifications. Before payment, you expressly request immediate supply of the full version and acknowledge that you lose your 14-day right of withdrawal from the moment the full version is made available to you. We send confirmation of this consent to your email. This does not limit your rights if the product is non-conforming or defective.
Your rights under the Consumer Protection Code (CDC), including in respect of non-conformity of the product, are preserved in full.
8. Licence to use
Upon payment, you receive a perpetual, worldwide, non-exclusive licence to use the product for personal, non-commercial purposes: listening and viewing, giving it as a gift, showing it at events, and posting it on personal social media accounts and in messengers.
Without a separate written agreement, you may not: sell or resell the product, use it to advertise goods or services, publish it on streaming platforms (Spotify, Apple Music, etc.) or register rights in the product. We may keep a copy of the product to fulfil the order and for re-delivery, but we will not publish it without your written consent.
9. Your materials
By sending stories, names, photos and other materials, you confirm that you have the right to share them and that the people concerned do not object. Photos of children may be sent only by their parents or guardians. You grant us a limited licence to use these materials solely to fulfil your order. Storage and deletion are described in our Privacy policy.
10. Prohibited orders
We do not fulfil orders that contain: imitation of the voice, likeness or style of specific celebrities or real people without their consent; lyrics or melodies of other people’s songs; third-party characters, logos and trade marks; sexual content; insults, threats, discrimination or harassment; content that is misleading or could be used for fraud; or anything that breaks the law. The full list is set out in our AI and content policy.
11. AI and copyright
Parts of the product are created using AI tools whose use by us is permitted under the commercial licence of the relevant service. In many countries, content generated by AI without sufficient human creative input is not protected by copyright. We therefore grant a licence to use the product (section 8), but do not guarantee that copyright in the product can be registered.
12. Liability
We are responsible for ensuring that the product matches the approved preview and the description on the website. Our total liability in respect of an order is limited to the amount paid for that order. We are not liable for indirect losses, or for delays caused by incorrect contact details in the order request or by events beyond our control. Nothing in these terms limits the rights you have under the mandatory consumer protection laws of your country.
13. Sanctions
We do not sell to customers located in Russia, Belarus, Iran, North Korea, Cuba, Syria or the temporarily occupied territories of Ukraine, or to persons on the sanctions lists of the United Kingdom, the EU, the United States or the UN. Such orders are cancelled and refunded where permitted by law.
14. Governing law and disputes
These terms are governed by the law of England and Wales. If you are a consumer, you also retain the protection afforded by the mandatory provisions of the law of your country of residence and may bring proceedings in the courts of that country.
For customers in the United States, these terms are governed by the law of the State of Delaware, United States, without regard to its conflict-of-laws rules, subject to the mandatory consumer rights of your state.
Before contacting your bank or a court, please write to us at support@sonadoraproduction.com: we reply within 24 hours and resolve most issues without a dispute.
15. Changes to these terms
We may update these terms. The new version is published on this page with its date and applies to orders paid for after publication.
